Not sufficient evidence to prove sexual assault

The Sexual Misconduct Committee ruled that there was not sufficient evidence to prove the alleged sexual assault reported on January 24 by a former female student against three male students.

According to Dean Malloy, the Committee, Paul Millette and Teresa Coker, interviewed all relevant people, including many students who were at the party where the assault was said to have happened. The student that reported the assault left campus for the rest of the semester, but did return for interviews.

Dean Malloy said it was difficult to reach a decision because of many conflcting stories, and with alcohol involved he says there are “different degrees of intoxication” making it hard to prove whether someone could consent to sex or not.

Malloy amitted that delivering the news to the female student was difficult, but in a letter sent to her it stated that there was too much ambiguity “to conclude that the sex was non-consensual.” The dean says she has a lawyer, so he doesn’t know where it will go from here, although the case is closed on campus.
